Experian MCN Bikecheck - Terms And Conditions

  1. Important Information

    These Terms and Conditions relate to your use of the MCN Bikecheck service made available to you at [www.mcnbikecheck.co.uk] ("the Website") and apply to all MCN Bikecheck searches made by you on or after 1st December 2006 (version 1.0).

    Please read these terms and conditions carefully before conducting a MCN Bikecheck search, and retain a copy for your information.

    MCN Bikecheck is a service brought to you by Experian Limited (company number 00653331) whose registered office is at Talbot House, Talbot Street, Nottingham, NG80 1TH and which is an Appointed Representative of Motorfile Limited (company number 03009493), a company regulated by the Financial Services Authority. VAT Registration number: [887 1335 93].

    Both Experian Limited and Motorfile Limited are members of the Experian group of companies. References to "we", "us" and "our" in these Terms and Conditions shall be to Experian Limited.

    Please note that the service provided pursuant to this Agreement is personal to you and only you may benefit from the results of any MCN Bikecheck search conducted. Additionally, you must be over the age of 18 years in order to benefit from the Motorcycle Data Insurance.

  2. Conducting A MCN Bikecheck

    Please see our Step By Step Guide on the Website for further details.

    After registering and before proceeding to request a MCN Bikecheck search, you must choose whether you want to purchase a single MCN Bikecheck search or multiple MCN Bikecheck searches and provide us with payment of the appropriate fee (as indicated on the Website) in advance of any search. Once you have submitted a request for a MCN Bikecheck search you may not stop that request.

    The results of each MCN Bikecheck search will be delivered to you electronically on your computer screen via the Internet and you will be sent an e-mail to confirm that payment has been taken and/or provide you with confirmation of your search and details of a hyperlink at which you can view your MCN Bikecheck search results ("Confirmation E-mail"). You will be able to view an archived record of your MCN Bikecheck search results for a period of up to 27 months following your search if you click on the section entitled "View My Checks".

    If you have chosen the single MCN Bikecheck service, known as "MCN Bikecheck Solo", and conducted a single MCN Bikecheck search, you may register with Pinnacle Insurance plc the vehicle to which the single MCN Bikecheck search relates. This will entitle you to receive the benefit of the Motorcycle Data Insurance in respect of the single MCN Bikecheck search conducted in respect of that vehicle, subject to separate terms and conditions relating to the Motorcycle Data Insurance which are set out on the Website.

    If you have chosen the single MCN Bikecheck search, but you then wish to conduct further searches, you will have to pay for the further searches at the appropriate rate.

    If you have chosen the multiple MCN Bikecheck service, known as "MCN Bikecheck Multi", and have paid for the searches, you may conduct up to a total of 5 (five) MCN Bikecheck searches without paying a further fee, provided such MCN Bikecheck searches are conducted by you within 60 days of confirmation of receipt of payment by us. Once you have conducted your MCN Bikecheck searches, you are entitled to choose 1 (one) of those vehicles on which you have conducted a MCN Bikecheck search to register with Pinnacle Insurance plc to entitle you to receive the benefit of the Motorcycle Data Insurance, subject to separate terms and conditions relating to the Motorcycle Data Insurance. Please note that in connection with the multiple MCN Bikecheck service, once you have registered a vehicle for the Motorcycle Data Insurance, you will be unable to conduct any further MCN Bikecheck searches in respect of the that MCN Bikecheck Multi service. For example, if you choose the multiple MCN Bikecheck service, make three MCN Bikecheck searches, and then register your vehicle with Pinnacle Insurance plc for the Motorcycle Data Insurance, the two remaining MCN Bikecheck searches will automatically expire.

    In order to successfully conduct a MCN Bikecheck search, the vehicle against which you wish to search must be registered in the United Kingdom (including Northern Ireland). For the avoidance of doubt, this does not include vehicles registered in the Channel Islands or the Isle of Man.

  3. Price And Payment

    By accepting these Terms and Conditions, you agree to pay: (a) the fee for a single MCN Bikecheck search, where you have opted to make only 1 (one) MCN Bikecheck search (the MCN Bikecheck Solo); or (b) the fee for MCN Bikecheck Multi, where you have opted to make up to 5 (five) MCN Bikecheck searches (the multiple MCN Bikecheck service).

    Payment for the MCN Bikecheck service must be made by credit or debit card in advance. Cash or cheques will not be accepted. On clicking "submit", your request to register with us for a MCN Bikecheck search and report shall be submitted and payment shall be deducted from your debit or credit card.

    No MCN Bikecheck search can be conducted until advance payment has been made. Please note that (except in respect of the Cooling Off Period as outlined in Section 5 below) there will be no refund of the fee paid for any multiple MCN Bikecheck service where you do not use up your full entitlement within the 60 day period from confirmation of receipt of payment by us.

  4. Use Of Information

    All information delivered to you (whether on a computer screen, in e-mail, or paper format) as part of any MCN Bikecheck search ("the Information") shall at all times belong to us or our licensors.

    For your own personal non-commercial use, you may display the Information on a computer screen, print individual pages onto paper (but not photocopy them) and store such Information in an electronic format (but not on any server or other storage device connected to a network). For the avoidance of doubt, you shall not: (a) reproduce, modify, or distribute the Information, (b) create a database from the Information, and/or (c) commercially exploit any of the Information; and/or (d) sell, transfer, deal in or otherwise make available either the ability to conduct a search or any Information to any 3rd party.

  5. Queries, Complaints, Cancellation And Refunds

    Cancellation

    If you have paid for the MCN Bikecheck service (whether that be for the single or multiple MCN Bikecheck service) in advance, but you no longer wish to conduct any MCN Bikecheck searches and provided you have not conducted any MCN Bikecheck searches, you shall have the right to cancel the MCN Bikecheck service at any time during the period of 7 Working Days immediately following the date on which you paid for MCN Bikecheck service in advance and received a Confirmation E-mail concerning the same. We refer to this period of 7 Working Days as the "Cooling Off Period". For the purposes of the Cooling Off Period, when we refer to "Working Days" we mean all days other than Saturdays, Sundays and public holidays.

    To exercise this right to cancel you must e-mail us at mcnbikecheck@uk.experian.com with the subject matter stated as "Cancellation" within the Cooling Off Period with your request to cancel the MCN Bikecheck service.

    Where a MCN Bikecheck service has been cancelled in the way described above, there will be no obligation for us to provide you with the MCN Bikecheck service and any payment received by us from you in respect of the cancelled MCN Bikecheck service shall be refunded to your debit or credit card (whichever card details you provided us with) no later than 30 days after receipt of your request to cancel.

    However, if you have paid in advance for the MCN Bikecheck service (whether that be for the single or multiple MCN Bikecheck service), and at any time during the Cooling Off Period you conduct 1 (one) or more MCN Bikecheck search(es), then your right to cancel the MCN Bikecheck service shall cease immediately.

    Queries

    If you are having problems viewing your MCN Bikecheck report or if you consider that some of the Information contained in the results of your MCN Bikecheck search may be incorrect, please contact us immediately and we shall (where possible) rectify the issue as soon as reasonably practicable at our own cost. Please note, that in this instance your sole and exclusive remedy shall be to obtain replacement Information.

    Complaints

    If you wish to make a complaint regarding either your MCN Bikecheck report or the MCN Bikecheck service, please write to Experian Limited, Talbot House, Talbot Street, Nottingham, NG80 1TH. If your complaint relates to the Motorcycle Data Insurance provider Pinnacle Insurance plc or if you have a claim under your Motorcycle Data Insurance policy, you may refer the matter to the Motorfile Claims Department, Lambert House LHN1, Talbot Street, Nottingham, NG80 1LH. Alternatively, you may contact Pinnacle Insurance plc directly by writing to the Customer Relations Manager, Pinnacle Insurance plc, Pinnacle House, A1 Barnet Way, Borehamwood, Hertfordshire WD6 2XX.

    If you are unable to settle your complaint to your reasonable satisfaction through the means stated above, you may refer the matter to the Financial Ombudsman Service at South Quay Plaza, 183 Marsh Wall, London, E14 9SR.

  6. Warranties And Disclaimers

    Whilst we shall use all reasonable skill and care in the supply of the Information to you, we do not warrant that any Information we supply you shall be error free.

    Whilst all reasonable skill and care has been taken by Experian in procuring and sourcing Information which is provided to you as part of the MCN Bikecheck service this Information has been supplied to us by third parties, and Experian therefore cannot warrant that (nor can it be held responsible for ensuring that) any of the Information provided to you as part of the MCN Bikecheck service is correct, accurate or complete.

    The MCN Bikecheck service does not deal with or comment on (a) the physical condition of any vehicle, (b) the roadworthiness or safety of any vehicle, (c) whether the vehicle has been 'written off', unless it was written off by an insurance company, (d) whether any vehicle is a "clone" bearing a false vehicle registration mark and vehicle identification number, or (e) whether any vehicle was originally purchased and/or imported from another European Union country other than the UK. Accordingly, you will have to satisfy yourself in respect of these aspects of any vehicle(s) you intend to or in fact purchase. Please read the section on the Website entitled 'Important Information' for further details.

    All you need to do to take advantage of the Motorcycle Data Insurance is to register with Pinnacle Insurance plc your chosen vehicle (see section 7 below for further details) on which you have conducted a MCN Bikecheck search. There is no additional cost to you for registering for this Motorcycle Data Insurance. Subject to the Motorcycle Data Insurance terms and conditions, by registering for the MCN Bikecheck Insurance you are covered in respect of your chosen vehicle (see section 7 below for further details) by the MCN Bikecheck Insurance policy. Apart from any entitlement you may have to compensation under the Motorcycle Data Insurance, our liability to you shall be limited to the price you paid for the MCN Bikecheck service. That said, nothing in these Terms and Conditions shall limit or exclude our liability to you for death or personal injury resulting from our negligence or breach of statutory duty, or that of our employees, servants or agents.

    We shall not be liable for any loss or damage suffered by you which is or was not reasonably foreseeable arising out of your use of the Information.

    We shall not be liable to you for events beyond our reasonable control.

    All other warranties, conditions, and representations (other than fraudulent misrepresentations) whether express or implied shall be excluded (to the extent that we are legally permitted to do so).

  7. Motorcycle Data Insurance

    Each time you pay for a MCN Bikecheck service (whether this is the single or the multiple MCN Bikecheck service) and subsequently conduct one or more MCN Bikecheck searches as appropriate to your chosen MCN Bikecheck service, you shall be entitled to register 1 (one) vehicle with Pinnacle Insurance plc for Motorcycle Data Insurance.

    For example: if you purchase the multiple MCN Bikecheck service enabling you to search our databases in respect of up to 5 (five) vehicles, you shall be entitled to register one of those vehicles (namely the one you buy) with Pinnacle Insurance plc.

    Provided that you register your chosen vehicle with Pinnacle Insurance plc (and subject always to the Motorcycle Data Insurance terms and conditions), if you believe or discover that specific information or data provided to you as part of any MCN Bikecheck search is incorrect, inaccurate or incomplete, then you may be entitled to make a claim under the Motorcycle Data Insurance. Please see the Motorcycle Data Insurance terms and conditions for further details.

    For the avoidance of doubt, Motorcycle Data Insurance only provides cover in relation to the specific data provided to you as part of a MCN Bikecheck report. Neither Experian nor Pinnacle Insurance plc provides insurance in relation to any vehicle, its use and/or the driver as part of this MCN Bikecheck service or the Motorcycle Data Insurance. You will need to make your own arrangements to ensure that it is safe and legal for you to drive any vehicle you purchase as a result of conducting a MCN Bikecheck search.

  8. General

    These Terms and Conditions form the entire agreement between us.

    No third party may use or rely on any Information provided to you as a result of or pursuant to you conducting a MCN Bikecheck search.

    A person who is not a party to these Terms and Conditions has no right to enforce any term under them.

    You may not assign, novate or otherwise transfer all or any of the rights granted to you under these Terms and Conditions.

    These Terms and Conditions are governed by English law. In the event of a dispute arising between us, these Terms and Conditions shall be subject to the exclusive jurisdiction of the English courts, unless you reside in Scotland, Wales or Northern Ireland, in which case an action may be brought by you in the courts of the country in which you reside.

Who Is The Insurer?

Eligibility

You will be eligible for Motorcycle Data Insurance provided you:

  • are aged at least 18 years; and
  • have paid the cost of the Motorcycle Data Check at the commencement date.

What are the benefits and features?

We will pay you, except where and to the extent that a warning specifically limiting the benefits has been given in the Motorcycle Data Check, for:

  • any outstanding loans or finance on the insured motorcycle by previous owners;
  • the loss of the vehicle as a result of it having been reported stolen prior to you purchasing it;
  • the reduction in market value of the motorcycle (not exceeding 50% of the purchase price) due to the Motorcycle Data Check search being inaccurate in respect of total loss, upto a maximum of £15,000; and
  • the reduction in market value of the motorcycle (not exceeding 10% of the purchase price) due to the Motorcycle Data Check search not recording the motorcycle as an import or export motorcyle, up to a maxiumum of £3000.

What am I NOT coved for under Motorcycle Data Insurance?

The most significant exclusions of this policy are set out below, but there are other exclusions that may be significant to you. For full details of the exclusions, please refer to Clause 3 in the policy document.

Benefits will not be paid:

  • where the result of loss, destruction or damage to the insured vehicle occurs after the Motorcycle Data Check search has been performed;
  • where the motorcycle has been purchased outside of the United Kingdom;
  • for any loss where a vehicle has been purchased without a valid MOT Test Certificate (where compulsory);
  • for any loss as a result of the vehicle bearing false Vehicle Registration Marks or Vehicle Identification Numbers;
  • for any loss arising from a fraudulent transaction;
  • for legal costs or expenses incurred by you; or
  • for any loss sustained where the vehicle has not been purchased from the registered keeper if a private sale.

How long does the Motorcycle Data Insurance cover run for?

The policy will last for the insured period of 24 months from the commencement date.

What happens if I take out the Motorcycle Data Insurance cover and then change my mind?

You may cancel this cover within the first 14 days. However, in view of the small amount of premium and the immediate incidence of risk under this policy, no refund is payable.

How do I make a claim under Motorcycle Data Check Insurance

If you wish to make a claim you can obtain a claim form from Experian by writing to Experian Claims Department, Lambert House, Talbot Street, Nottingham, NG80 1LH or telephone 0870 333 8030. Written notice of the facts on which the claim in made to Experian must be provided within 30 days of the date of loss.

How do I make a complaint about Pinnacle Insurance plc and my Motorcycle Data Check Insurance?

We will confirm we have received your complaint within five working days and will do our best to resolve the problem within four weeks. Would I receive compensation if Pinnacle Insurance plc were unable to meet its liabilities?

Pinnacle Insurance plc is covered by the Financial Services Compensation Scheme. You may be entitled to compensation from "the Scheme" if we cannot meet our obligations. This depends on the type of business and circumstances of the claim.

THIS POLICY records that in consideration of purchasing the Motorcycle Data Check, the Company will provide the insurance cover described in this policy in respect of the insured. Furthermore, this policy is subject to the terms and conditions set out below.

  1. INTERPRETATION

    In this policy, the following words have the following meanings:

    • "Commencement Date" means in respect of each insured motorcycle, the date the Motorcycle Data Check is performed;
    • "Company" means Pinnacle Insurance plc, Pinnacle House, A1 Barnet Way, Borehamwood, Hertfordshire WD6 2XX;
    • "Experian" means Experian Limited, Talbot House, Talbot Street, Nottingham NG80 1TH;
    • "Glass's" means Glass's Information Services Limited, 1 Princess Road, Weybridge, Surrey, KT13 9TU - the provider of used vehicle valuations;
    • "Import" means the insured motorcycle has been used outside the European Union before its first registration with the DVLA or DVLNI;
    • "Insured" means the individual who is provided with the information and who is named in the Motorcycle Data Check as the purchaser of the insured motorcycle;
    • "Insured Period" means in respect of each insured motorcycle, a period of 24 months from the commencement date;
    • "insured motorcycle" means the motorcycle or scooter identified in the Motorcycle Data Check which has been purchased in the United Kingdom by the insured after the commencement date;
    • "Market Value" means the average retail value calculated by Glass's for a vehicle of the same type, age, mileage and average condition as the insured motorcycle;
    • "Motorcycle Data Check" means the online service provided by Experian which gives infomration in respect of the insured motorcycle;
    • "Reasonably Prudent Purchaser" means a purchaser who is deemed to be put on notice that the genuineness of the motorcycle may not be as portrayed by the vendor and must take all precautions to avoid loss when purchasing the motorcycle by carefully checking that all information supplied by the seller during the purchase is correct;
    • "Total Loss Insurance Claim" means a claim for damage to the insured motorcycle under a policy of motor insurance which is settled by the motor insurer prior to the commencement date by the provision of a replacement motorcycle or by a monetary payment because the insured motorcycle is considered to be beyond economic repair. This information must be verified by a member company of the Association of British Insurers or by Underwriters at Lloyds of London;
  2. BENEFITS
    • 2.1. The Company will, except where and to the extent that a warning specifically limiting the benefits has been given in the Motorcycle Data Check, cover the insured for:
      • 2.1.1. their actual financial loss within the insured period arising solely and directly from the Motorcycle Data Check being inaccurate or incomplete due to:
        1. the settlement by the insured of outstanding loans or other finance secured against the insured motorcycle by previous owners; or
        2. the purchase of the insured motorcycle where the insured motorcycle is the salvaged motorcycle following a category A or B total loss insurance claim as confirmed by the insurer making that declaration; or
        3. the loss of the insured motorcycle (or additional payments being made by the insured with the agreement of the Company to secure full title to the insured motorcycle), due solely to the insured motorcycle having been reported stolen to the police prior to the commencement date and the insured failing to obtain good title to the insured motorcycle.
        In respect of any one insured motorcycle, the maximum benefit payable under Clause 2.1.1. shall be the market value of the motorcycle on the date of receipt of a claim by the Company, up to a total maximum of £30,000 in respect of this policy.
      • 2.1.2. the actual reduction in market value of the insured motorcycle arising within the insured period due solely and directly from the Motorcycle Data Check in respect of total loss insurance claims (apart from Category A or B) being inaccurate or incomplete, up to a total maximum of 50% of the purchase price of the insured motorcycle or £15,000 in respect of this policy.
      • 2.1.3. the actual reduction in market value of the insured motorcycle arising within the insured period due solely and directly from the Motorcycle Data Check not recording the insured motorcycle as an import or export motorcycle, up to a total maximum of 10% or the purchase price of the insured motorcycle or £3,000 in respect of this policy;
    • 2.2. The Company will, in addition to the benefits described in Clause 2.1. above, pay to the insured, in respect of each of the circumstances set out below, a one-off lump sum payment equal to £50 (except where and to the extent that a warning specifically limiting the benefits has been given in the Motorcycle Data Check) if:
      • 2.2.1. the colour of the insured motorcycle given in the Motorcycle Data Check does not match the colour registered with the DVLA or DVLNI and confirmed on the insured motorcycle's vehicle registration document (V5C);
      • 2.2.2. the number of previous registered keepers of the insured motorcycle given in the Motorcycle Data Check does not match the number of previous registered keepers registered with the DVLA or DVLNI and confirmed on the insured motorcycle's vehicle registration document (V5C);
      • 2.2.3. the mileage details for the insured motorcycle are recorded in the Motorcycle Data Check - a previous higher mileometer reading is not shown in the Motorcycle Data Check.
      The insured will need to provide written documentary evidence to the Company's reasonable satisfaction when making a claim.
  3. EXCLUSIONS

    The Company shall not be liable for:

    • 3.1. the results of loss, destruction or damage to the insured motorcycle occurring after the commencement date;
    • 3.2. any loss resulting from an insured motorcycle which is not registered with the DVLA in the United Kingdom (or DVLNI in Northern Ireland) or which bears a Vehicle Registration Mark with the prefix or suffix letter Q or losses in respect of motorcycles registered in Jersey, Guernsey or the Isle of Man;
    • 3.3. any motorcycle purchased outside the United Kingdom;
    • 3.4. any loss resulting from any incident prior to the insured motorcycle's first registration with the DVLA or DVLNI;
    • 3.5. any loss in respect of an insured motorcycle purchased without a valid MOT Test Certificate (where compulsory);
    • 3.6. the purchase of a motorcycle where the Vehicle Identification Number supplied by the insured does not correspond with the Vehicle Registration Mark held by the DVLA or DVLNI for that Vehicle Identification Number;
    • 3.7. any loss arising from a fraudulent transaction which prevents good title being passed from the vendor;
    • 3.8. any loss as the result of the insured motorcycle bearing false Vehicle Registration Marks or Vehicle Identification Numbers;
    • 3.9. legal costs or expenses incurred by the insured;
    • 3.10. the cost of repair to or refurbishment of the insured motorcycle, loss of anticipated profit from its use or sale, loss of use or any financial loss connected with the loss of use or any losses relating to business interests, including without limitation, lost data, lost profits, loss of opportunity or business interruption;
    • 3.11. any consequence of war, invasion, act of foreign enemy, terrorism, hostilities (whether war be declared or not), civil war, rebellion, revolution, insurrection or military or usurped power or
    • 3.12. VAT recoverable by the insured.
  4. CONDITIONS
    • 4.1. The insured must be at least 18 years of age to be eligible to qualify for cover under this insurance cover.
    • 4.2. The cost of the Motorcycle Data Check must have been paid at the commencement date.
    • 4.3. No benefit is payable under this insurance if the insured at the time of the Motorcycle Data Check has any prior knowledge of the circumstances which give rise to a claim; or failed to confirm before making the purchase that the Vehicle Identification Number held by Motorcycle Data Check matched the Vehicle Identification Number on the motorcycle and the V5C; or failed to confirm that the Vehicle Identification Number, Vehicle Registration Mark and other details provided as part of the Motorcycle Data Check were compatible with those of the actual motorcycle; or ignored any information disclosed by the Motorcycle Data Check which would reasonably put a potential purchaser of the insured motorcycle on notice that the insured motorcycle should not be purchased.
    • 4.4. The insured is under an obligation to act as a reasonably prudent purchaser in the event that the purchase price of the motorcycle is 30% or more below the market value and not to purchase the motorcycle if any details provided by the vendor do not match the Motorcycle Data Check.
    • 4.5. If the insured motorcycle is being bought privately (i.e. not from a motorcycle dealer) then the insured must purchase the insured motorcycle from the keeper stated on the V5C registration document and obtain a valid receipt. In all cases the insured must verify the identity of the seller, and check their name and address against the details in the motorcycle registration document (V5C).
    • 4.6. The Company shall have the right to inspect the insured motorcycle and the insured shall provide to the Company at their own expense and in writing all details of the claim together with such proofs, explanation and other evidence as may be reasonably required by the Company.
    • 4.7. All benefit under this insurance is forfeited if any claim made by the insured is knowingly false or fraudulent.
    • 4.8. The Company may at its expense take such proceedings as it sees fit in the name of the insured to enforce any rights and remedies against or obtain relief or reimbursement or compensation from other parties to which the Company shall be or may become entitled or subrogated under this insurance and the insured shall at the request and expense of the Company do such acts and things as may reasonably be required by the Company for that purpose.
    • 4.9. The insured shall take all reasonable precautions to avoid losses which are or may be recoverable under this insurance.
  5. CLAIMS
    • 5.1. In the event of any occurrence giving rise or likely to give rise to a claim under this policy the insured must at their own expense and without delay:
      • 5.1.1. Request a claim form from Experian Claims Department, Lambert House, Talbot Street, Nottingham NG80 1LH, Telephone: 0870 333 8030; and
      • 5.1.2. Send written notice of the facts on which the claim is made to Experian at the above address in a form approved by the Company and provide to Experian any additional information as the Company may reasonably require, including full details of all efforts made to recover any loss incurred as soon as reasonably possible and in any event within 30 days of the date of loss.
    • 5.2. If in the Company's reasonable opinion the insured has not taken all reasonable steps to recover the loss from the person or company from whom the motorcycle was purchased or from any other party against whom there may be a right of action, the Company reserves the right to withhold settlement of any claims until such time as such steps have been taken.
  6. CANCELLATION

    The insured may cancel this insurance within 14 days of receiving the policy documentation. However, in view of the small amount of premium and the immediate instance of risk under this policy, the insured will not receive a refund of any part of the premium once the Company's time on risk and reasonable administration fee have been levied. All cancellation requests should be made in writing to Experian.

  7. GENERAL CONDITIONS
    • 7.1. The contract between the insured and the Company is made up of this policy and any endorsement to this policy.
    • 7.2. This policy cannot be assigned or charged in any manner whatsoever.
    • 7.3. This policy shall not acquire a surrender value.
    • 7.4. The parties to this insurance are free to choose the law applicable to it. Without agreement to the contrary English Law will apply. If the insured lives in Scotland, Northern Ireland, the Channel Islands or the Isle of Man, the insured will be entitled to commence legal proceedings in their local courts.
    • 7.5 The Company is covered by the Financial Services Compensation Scheme (the "Scheme"). The insured may be entitled to compensation from the Scheme if the Company cannot meet its obligations. The amount of compensation depends on the type of business. Most types of insurance business are covered for 100% of the first £2,000 of a valid claim and 90% of the remaining amount of the loss. ENQUIRIES AND COMPLAINTS

While it is always the Company's intention to provide a first class standard of service, if the insured does have any concerns regarding this insurance cover, please in the first instance address them to:

Should the matter remain unresolved the insured should then write to:

Should the insured remain dissatisfied with the outcome of any internal enquiries, the insured has the right to refer the complaint to:

The Financial Ombudsman Service (FOS) South Quay Plaza, 183 Marsh Wall, London E14 9SR.

This procedure will not prejudice the insured's right to take legal proceedings. However, please note that there are some instances when the FOS cannot consider complaints. A leaflet detailing the full complaints/appeals process is available from the Company on request.
